Why Mediate?
Mediation is a private and confidential process whereby an experienced neutral facilitates a settlement of a commercial dispute. Mediation is usually considered to be a better choice that either litigation or arbitration because if successful the parties will be spared the expense and disrupted relationship that so often follows when a settlement is imposed on the parties by an award or judgment. In mediation the parties find their own solution to their problems.
The mediator will have developed an understanding of the parties, the issues and the underlying obstacles to a settlement and will encourage and facilitate the settlement of the dispute and, if possible, the reconciliation of the parties.
